    Cloudmont Alabama’s only ski area posted on their Facebook page this week, they will not open this season due to family illness.

    I’m curious why Leitner obligated itself to this tramway payout for this incident because this really opens a loop hole (in my opinion) for future lawsuits against all manufacturers. Any lawyer can use this case as an example regardless the manufacturer was at fault. Maybe I read the article wrong, but I’m just saying.

      My guess is that they felt they had to because they performed work directly on the lift; they weren’t simply the manufacturer and all of the work had been done by third parties.

      I agree with ppropetech. The fact that they had the maintenance contract and had performed work was involvement beyond “manufacturer”. This is like a plea of Nolo contrendre- you don’t admit fault or guilt. As I read it, they settled out of court. But the Italian courts are fairly strict. Leitner and their 3 employees could still be found guilty / liable.
